In Guam v. United States, the Supreme Court resolved a circuit split on how entities that clean up Superfund sites regulated under CERCLA can pursue costs from other parties responsible for the hazardous waste. It enables them to hold polluters accountable for cleanup costs and short-circuits legal maneuvering that previously allowed the United States military to escape its share of financial responsibility.
