The Rise of Anti-Regulatory Legal Advocacy: The Farm Bureau Case Study

While the public perceives the American Farm Bureau
Federation and its state affiliates as innocuous insurance providers
and traditional advocates for the family farmer, they are in fact
responsible for a wide-ranging, corporatist siege on the U.S.
regulatory state. This Article reveals the true nature of Farm Bureau’s
unique hybrid structure—a 501(c)(5) nonprofit network fronting for
multi-billion dollar insurance and agribusiness interests and a wider
web of corporate dark money. Positioning itself as a grassroots
agricultural voice, the organization leverages its nonprofit status to
exploit the lack of transparency afforded to corporate actors post-
Citizens United, effectively shielding its lobbying, litigation, and
funding from public accountability. Through empirical analysis of
Farm Bureau litigation and amicus activity from 2020 through 2025,
the Article documents strategic deployment of legal resources
designed to dismantle federal and state oversight across a broad
spectrum of public interests, including environmental standards
(CWA, ESA, NEPA), labor protections, immigration policy,
occupational safety, and pesticide exposure. This case study uncovers
how corporate financial power, filtered through a nonprofit shell, is
fundamentally redirecting natural resource policy and the future of
federal administrative authority.
